TERMS AND CONDITIONS FOR ON CAMPUS COURSES

Herein, Saveba Pty Ltd ABN 64 002 7287 985 trading as Coco Republic Design School will be referred to as CRDS

Location and Date

The Courses will take place at the CRDS campus in Alexandria, Sydney and designated pop up studios in Australia. Details of the course dates and time will be advised to you by email on confirmation of your place.

Language/Literacy

All CRDS courses are taught in English. It is assumed that you are sufficiently proficient in English to comprehend design language terminology. If you have any concerns, please contact CRDS to discuss.

Entry to CRDS

There is no entry requirement for CRDS courses except where noted, the previous experience or study may be a pre-requisite. Student should be aged 17 years or over. All Student are treated equally. Our teaching staff will assist and support student where appropriate.

Course Description

Most courses are run in a classroom-style or studio environment. However, students will receive both theory and practical training which may require the student to spend time outside the campus for short periods.

Outcome

Upon successful completion of your chosen course, each student will be presented a CRDS certificate, plus receive a transcript, posted separately, from TAFE NSW Sydney Institute, giving students formal national accreditation for unit(s) studied.

Refund Policy for fees paid

Submit all requests for refunds in writing to the CRDS Head of Design School To secure your application (if more than fourteen days prior to the commencement of the course) a deposit of $250 is required together with the submission of a CRDS Application Form. This deposit is non-refundable.

The fees are payable in full fourteen days prior to the commencement of any CRDS course. For those having paid a deposit, the balance of the payment is due at this time.

A student can cancel their enrolment at any time, however a financial fee will occur

A full refund of your deposit minus an administration fee of $250 (inclusive of GST) will be issued if you cancel 14 days prior to an accredited course commencement.

Refunds are not available once the course has commenced, though the course can be completed at a later stage subject to a position being available. Deferment of Study In the event that a student is unable to attend their chosen course in a particular Term (given at least 30 days notice prior to course commencement your booking and payment is transferable to another Term or person (maximum 2 transfers only).

In the event that a course is oversubscribed or cancelled by CRDS for any reason, students have the option of transferring to another course, or receive a full refund. In the event of a class being cancelled, students will be notified 5 working days prior to class commencement. Students may defer their study only in exceptional cases and only up to a maximum of six months. An application to defer must be received in writing to the CRDS Head of Design School for consideration. Completion of the Application Form is confirmation that you accept and commit to paying the fees as stated.

Complaint Procedure

Any student complaints are to be directed to the Head of Design School. Confidentiality is assured and your complaint will not hinder your education at CRDS in any way.

Conduct

Students are expected to act within an acceptable code of conduct. In the case of an incident arising, discipline may be initiated by a CRDS staff member and if required, a further meeting may be scheduled with the CRDS Head of Design School and/or a senior Design Centre Enmore (TAFE NSW) representative.

The Coco Republic Design School in co-operation with the Enmore Design Centre is committed to making the learning of design an enriching and joyous experience.

Use of Course Material

You must not use the Course Material for any purpose. This includes:

  1. A. the reproduction of the Course Material in any material form;
  2. B. the distribution or selling of the Course Material in any material form;
  3. C. re-transmission or storage of the Course Material by or in any medium of communication;
  4. D. uploading and/or posting the Course Material to any site on the internet;
  5. E. "framing" the material with other material on any Internet site.

The above acts are unlawful and are specifically prohibited. You must not modify or copy any of the Course Materials. CRDS reserves all intellectual property rights including but not limited to copyright, in and all the Course Material.

(These particular Terms and Conditions only apply to online learning and do not apply to the courses held at CRDS Campus or pop up studios)

Terms of Access to and use of this Website

This Website (referred to in these Terms of Access as the Website) is owned and operated by Saveba Pty Limited ABN 64 002 728 985 (CRDS). All design rights and other intellectual property rights on and in the Website are the exclusive property of the CRDS. The CRDS Website is available on the condition that you accept without alteration, the terms and conditions set out below. By continuing to access and use the Website you are agreeing to the terms and conditions set out below.

Links to other Websites

This Website may contain references to third party products and services (TPPS) and links to sites on the internet owned and operated by third parties and which are not under the control of the CRDS.

In relation to the other sites on the Internet, which may be linked to the Website, the CRDS:

a)  provides the links to other sites as a convenience to you and the existence of a link to other sites does not imply any endorsement or approval by the CRDS of the linked site or its content; and

b)  is not responsible for the material contained on those linked sites. Disclaimers

The CRDS does not warrant, guarantee or make any representation that:

a)  the Website, or the server that makes the site available on the internet are free of software viruses or functionality errors;

b)  the functions contained in any software on or in the Website, will operate uninterrupted or are error-free.

The CRDS is not liable to you for:

a)  errors or omissions on or in linked sites on the internet; nor

b)  delays to, interruptions of or cessation of the services provided in or on the Website, or linked sites, whether caused through the negligence of CRDS, its employees or independent contractors, or through any other cause. Use of information gathered

The CRDS and/or authorised personnel may gather and process the information:

a) which you may provide when accessing the Website, such as your name, address, email address and other personal information about you; and

b) regarding the way in which you use the Website including, without limitation, information acquired through the use of cookies programmed during your access of the Website.

Alteration of Terms of Access

The CRDS reserves the right to change its Terms and conditions:

a)  without notice; and

b)  without giving any explanation or justification for such change.

Relevant jurisdiction

If any part of this Agreement is found to be void, unlawful, or unenforceable then that part will be deemed to be severable from the rest of this Agreement and the severed part will not affect the validity and enforceability of any remaining provisions. This agreement will be governed by and interpreted in accordance with the laws of the State of New South Wales (NSW), Australia.

Conditions for use

The user agrees to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that are made including the content of your transmissions. By way of example, and not as a limitation, the user agrees NOT to:

i.    Defame, abuse, harass, stalk, threaten or otherwise violate the rights (such as rights of privacy and publicity) of other on-line students;

ii.   Publish, distribute and/or disseminate any harmful, obscene, indecent, unlawful, libellous, profane, defamatory, infringing, inappropriate, hateful, or racially, ethnically or otherwise objectionable materials or information;

iii.  Use another students personal data for any purposes whatsoever unless otherwise agreed with that student;

iv.   Submit materials that are unlawful or promote or encourage illegal activity or that would violate the property rights of others;

v.    Submit materials of any third party without such third partys prior written consent, or materials that falsely express or imply that such materials are sponsored or endorsed by CRDS;

vi.   Falsely state or otherwise misrepresent your affiliation with a person or entity, for the purpose of misleading others as to the identity of the sender or the origin of a message to harvest or otherwise collect information about others.

vii.  Transmit, email or post any materials that contains in any form software viruses or such programs as including but not limited to Trojan horses, worms, time bombs, cancel-bots, computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

viii. Use the CRDS on-line course material (the CRDS Service) in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Website.

ix.   Attempt to gain unauthorised access to the CRDS Services, other accounts, computer systems or networks connected to the CRDS Service, through password mining or any other means.

x.    Modify, adapt, translate, or reverse engineer any portion of the CRDS Service, or use any robot, spider, site search/retrieval application, or other device to retrieve or index any portion of the CRDS Service.

xi.   Reformat or frame any portion of the web pages that are part of the CRDS Service.

xii.  Disseminate content that infringes any patent, trademark, trade secret, copyright, rights of privacy or publicity, or other proprietary right of any party or infringes any intellectual property law or any other applicable law.

xiii. Remove any copyright, trademark or other proprietary rights notices contained in or on the CRDS Service.

xiv.  Disseminate any unsolicited or unauthorised advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of such solicitation.

xv.   Interfere with another students use and enjoyment of the CRDS Service.

xvi.  Harvest or collect email addresses or other contact information of students, including usernames, from the CRDS Website by electronic or other means.

Entry to CRDS

Except where a particular course type notes a requirement for previous experience or previous study, there are no entry requirements for any CRDS course. However, it is generally required that you be aged at least seventeen (17) years. The CRDS does not discriminate and treats all students equally. Our teaching staff assists and supports our students where appropriate.

Outcome

Upon successful completion of your chosen course, you will be sent a CRDS Certificate and where applicable, also receive a transcript, posted separately, from Design Centre Enmore, Sydney Institute Tafe NSW Australia, acknowledging your national accreditation for your unit(s) studied.

Refund Policy for fees paid

  • All requests for a refund must be made in writing to the CRDS Head of Design School
  • We offer a 7-day refund policy, where you may examine the first session for seven days. If you decide for any reason whatsoever not to proceed, simply email the Coco Republic Design School designschool@cocorepublic.com.au within this period for a full refund of fees paid less an administration fee of $250 (inclusive of GST)
  • .Refunds are not available after a course has commenced past 7 days
  • Refunds will not be given to students who do not complete their course within the specified 12 month time frame.
  • Course Extension

Coco Republic online courses must be completed within 12 months from sign up. It is recommended that exercises are submitted on a regular basis to ensure the workload is manageable. Should the student need an extension of time to complete the selected course, the student must apply in writing before the expiry of the 12 months to; designschool@cocorepublic.com.au. Fees may apply.

Course Content

The CRDS reserves the right without notice to modify, edit or delete course content at any time before delivery

Disclaimer and limitation of liability

CRDS' obligation and liability to you with respect to goods and services supplied and all terms, conditions, guarantees, warranties and representations that might otherwise be implied by statute or otherwise are hereby excluded to the maximum extent allowed by law. Certain legislation, including Schedule 2 of the Competitions and Consumer Act 2010, imply guarantees and impose obligations upon CRDS which cannot be excluded, restricted or modified. Where such statutory provisions apply and to the extent which CRDS is entitled to do so, its liability shall be limited at its option to: -

a)  In the case of supply of goods, the replacement of the goods or supply of equivalent goods; or

b)  The payment of the cost of replacing the goods or acquiring equivalent goods; or

c)  The payment of the cost of having the goods repaired; or

d)  The repair of the goods

Where such statutory provisions apply and to the extent which CRDS is entitled to do so, its liability shall be limited at its option in the case of the supply of services, to:

a)  The supply of the services again; or

b)  The payment of the cost of having the services supplied again.
